Allen R. Wolff is a shareholder in Anderson Kill's New York office.  Allen's practice concentrates in construction litigation, insurance recovery, and the nexus between the two, as well as in complex commercial litigation.  Allen is Co-chair of Anderson Kill's Construction Industry Practice group and Co-chair of Anderson Kill's Corporate and Commercial Litigation Practice group.  He also is a member of Anderson Kill's Hospitality Industry group and a member of the COVID Task group.

Allen advises policyholders on issues relating to insurance coverage in general liability, property, casualty, fiduciary liability, and Directors & Officers liability insurance matters. He represents owners, developers, contractors, retailers, municipalities, financial institutions, hospitality businesses, condominium associations and tenants' associations on a full range of property, construction, engineering, contract and insurance coverage disputes. He has also litigated a wide array of commercial, financial, employment, and intellectual property matters.

  • Represented municipality in coverage dispute arising out of property damage suffered at public buildings.
  • Defended general contractor in suit brought by sub-contractors for wrongful termination of their contracts in construction project. Successfully demonstrated in trial, with help from expert witnesses, that subcontractor had not properly performed or managed contract nor met specifications. Verdict in client's favor.
  • Represented New York shopping center developer on delay and change order claims involving construction of anchor store. Obtained significant arbitration award and financial recovery.
  • Represented construction contractor in dispute with insurance company over additional insured coverage.
  • Represented luxury condominium developer in dispute with construction contractors regarding failure to follow project specifications and failure to meet project deadlines. Case involved significant liquidated damages concerns. Resulted in favorable settlement for client.
  • Represented numerous designers and retailers relating to construction issues, tenant improvement, and build-out of store locations throughout the country. Assisted with review of contracts, advice during construction regarding work and payment issues, disputes following construction involving mechanics' liens and defects and insurance issues.
  • Represented construction contractor in coverage dispute involving complex insurance policy and fronting coverage.
  • Represented the owners and management of a luxury resort hotel in litigation, including a companion federal declaratory action relating to errors in the site work and soil compaction. Errors necessitated extensive repairs and rework to resort property. Settled out of court.
  • Represented New York property developer in insurance coverage dispute. Obtained significant insurance recovery.
  • Represented subcontractors as co-plaintiffs with U.S. Government in suit against general contractor for fraud arising out of contract work performed at Pearl Harbor. Case involved qui tam action and "whistleblower" issues. Successfully recovered approximately $1 million.
  • Represented lender in large foreclosure matter arising out of stalled construction project in New York. Obtained judgment for more than $20 million in favor of client and possession of property.
  • Represented New York condominium developer regarding construction dispute and insurance coverage issues arising from work performed by contractor. Obtained favorable settlement and coverage for both defense and liability.
  • Represented general contractor in large dispute with condominium association relating to multiple complex construction and engineering issues. Successfully mediated and settled case.
  • Defended developer in construction litigation and arbitration relating to the engineering and construction of the festival marketplace at Aloha Tower. Presented evidence through expert and lay witnesses, contracts, drawings and engineering analyses relating to design and contractual issues.
  • Represented client in international dispute over sales of goods relating to materials for construction of prefabricated homes. Obtained verdict in client's favor as to all claims after extended bench trial.
