Important Update Regarding Mandatory Posting Requirement of Employee Rights

On October 5, 2011, the National Labor Relations Board postponed the implementation date for its requirement that private-sector employers post a notice advising employees of their right to unionize. That requirement is described in our earlier Employment Law Insider Alert.

The NLRB postponed the notice-posting requirement by more than two months — from November 14, 2011, until January 31, 2012. The NLRB’s press release stated that the decision to extend the rollout period followed queries from small- and medium-sized businesses and trade organizations that fall under the NLRB’s jurisdiction, and was made in the interest of allowing for further education ensuring broad voluntary compliance.

Most private sector employers will be required to post the 11-inch by 17-inch notice which will be available at no cost from the NLRB and through its website.

No other changes in the original rule or notice have been made. Although several employer groups have challenged the NLRB’s right to require the posting, the NLRB said that was not the reason for the postponement.
