On December 17, 2018, the NYC Department of Housing Preservation and Development (HPD) uploaded a link through HPDONLINE so owners of three or more multiple dwellings can register and file the report of their properties’ bedbug history for the previous year online. This means that cooperatives and condominiums has until February 28, 2019, to complete HPD’s online application and report any bedbug infestation that took place from November 2017 through November 2018. Pursuant to Local Law 69, the electronic form will require the following information:
1. The building’s street address.
2. The number of dwelling units.
3. The number of dwelling units that had a bedbug infestation during the previous year.
4. The number of dwelling units that employed eradication measures for their bedbug infestation.
5. The number of dwelling units that still had a bedbug infestation after employing such eradication measures.
6. Certification that you will comply with Local Law 69’s distribution and/or posting requirements (as set forth below).
It is the co-op’s and condo’s responsibility to obtain this information from its tenants and unit owners. Once online filing with the HPD is completed, Local Law 69 also requires that co-ops and condos distribute or post a copy of the most recent online bedbug history form submitted, and a notice providing information on the prevention, detection and removal of bedbug infestations on a form approved by the NYC Department of Health and Mental Hygiene. These documents can be circulated in one of two ways: either distributed to each tenant upon each new lease or renewal lease, or posted in a prominent public location within the building within 60 days of the HPD filing while also keeping a record of such posting. Failure to timely file the online application, distribute the documents to tenants, or properly post the notice may result in HPD violations against the building.
