Daniel J. Healy is a partner in Anderson Kill's Washington, D.C. office. He started his career with Anderson Kill and then served over five years as a Trial Attorney with the U.S. Department of Justice, Tax Division. He appeared as lead trial counsel in federal and state courts across the country, received numerous Outstanding Attorney awards and served as the E-Discovery Coordinator for the Tax Division.

Dan currently is the Co-Chair of Anderson Kill's Cyber Insurance Recovery Practice Group, and a member of the firm's Technology, Media and Distributed Systems and Regulated Products Groups.  Dan has been selected by his peers for inclusion in The Best Lawyers in America for Insurance Litigation since 2018 and recognized by Super Lawyers as a Super Lawyer for Insurance Coverage since 2018.  In 2019, he was selected for inclusion in the American College of Coverage Counsel.

  • Represented the plaintiff in Kozlowski v. Corporate Officers and Directors Assurance Ltd. in a London arbitration proceeding for D&O coverage for the corporate conglomerate Tyco International, Ltd.
  • Represented the United States, as lead counsel, in United States v. Crissman, which involved claims to property subject to a mortgage that had been traded as part of a mortgage portfolio and was serviced by a mortgage servicing company. The U.S. District Court for the Middle District of Pennsylvania entered summary judgment in favor of the United States.
  • Represented the defendant in Aetna Life Insurance Company v. Esselte Corporation which resulted in a jury verdict in favor of Esselte. Esselte, an employer, was sued by the administrator (TPA) and insurer of its self-funded benefits plan over the payment of medical claims. The jury rendered a verdict that did not require Esselte, the defendant, to pay any of the medical claims, but required the plaintiffs to pay Esselte's attorneys’ fees.
  • Drafted the appellate briefs in McCauley v. First Unum Life Insurance Co. which resulted in a landmark decision from the Second Circuit that completely reversed the trial court's decision and remanded the case for a damages determination.
  • Represented the plaintiff in NetRatings, Inc. v. National Union Fire Insurance Co. which resulted in a settlement prior to the taking of any depositions. The plaintiff sought insurance coverage for patent infringement claims that had been brought against it based on its use of certain computer software and business methods.
  • Represented the defendant in The O Zon, Inc. v. Charles which resulted in the dismissal of all claims against the defendant after the defendant filed a single motion. The plaintiff had filed a complaint alleging claims under the Lanham Act, common law unfair competition and common law breach of contract all of which related to purported trade secrets claimed by the plaintiff.
  • Represented the plaintiff in Phaedra Partners Ltd. v. The Travelers Property Casualty Corp. which was settled just after the plaintiff filed its summary judgment motion. The plaintiff sought insurance coverage for business income and business interruption losses arising out of damage to several of its properties.
  • Represented the plaintiff in Symbollon Pharmaceuticals v. Rogan which resulted in a decision on summary judgment awarding a favorable priority date to the plaintiff for its PCT patent application. The U.S. Patent Office had denied the plaintiff the priority date claimed by the plaintiff in its PCT patent application allegedly based upon an error in the plaintiff's application. The U.S. District Court for the Eastern District of Virginia reversed that denial prior to discovery, finding that the Patent Office had committed an error.
  • Represented the United States in Millennium Marketing Group, Inc. v. United States involving allegedly unauthorized disclosures of the tax return information of a welfare benefits plan which claimed that it suffered nearly $50 million in damages. The U.S. District Court for the Southern District of Texas granted summary judgment in favor of the United States, dismissing all claims.
  • Represented the United States in CLIPT LLC v. United States, as lead counsel, in a tax shelter litigation involving TEFRA and so-called DAD transactions, Son of BOSS transactions and REPO transactions that were engaged in over the course of a six-year period. The litigation remains pending.
  • Represented the United States in United States v. Rocky Mountain Holdings, Inc. as lead counsel through trial and post-trial arguments. The United States sought to unwind fraudulent corporate transfers. The U.S. District Court for the Eastern District of Pennsylvania held that the United States had proven constructive fraud, including that the tax was foreseeable even though not yet due at the time of the fraudulent transfers, but concluded that the taxpayer entity had reasonably relied on the advice of counsel.
  • Represented the United States, as lead counsel, in numerous cases involving employment withholding tax liabilities: In United States v. McCloskey, the U.S. District Court for the Western District of Pennsylvania entered summary judgment in favor of the United States, finding the corporate officer liable for the tax liabilities despite that his bookkeeper had embezzled the funds that should have been used to pay the taxes. In United States v. Grello, the U.S. District Court for the District of New Jersey held the corporate officer personally liable and, because it found that the corporate officer had fraudulently transferred his house to his wife, it was subject to the tax liens.
  • Represented the United States in Estate of Robert Bowen v. United States, in which the estate claimed over $1 million as a refund based on the decedent’s purported yacht business. The U.S. District Court for the District of Maryland dismissed the complaint on summary judgment, holding the estate failed to prove any of its claims.
