Luma S. Al-Shibib is a shareholder in the New York office of Anderson Kill and co-chair of the firm’s Cyber Insurance Recovery Practice Group. She focuses her practice on insurance recovery for corporate policyholders, with an emphasis on cyber liability insurance, crime insurance, directors & officers liability insurance, and other claims-made professional liability insurance.

Ms. Al-Shibib is committed to public service, pursuing various local and international community projects in her personal time.  From 2010-2012, Ms. Al-Shibib served as a United States Peace Corps Volunteer to the Kalinago People in the Commonwealth of Dominica in the Eastern Caribbean, where, among other things, she worked on indigenous rights issues.  She also has volunteered with the International Rescue Committee in New York, working with the refugee resettlement unit, Habitat for Humanity in Chang Mai, Thailand, and New York Cares.

 

Cyber-Related Losses

  • Secured multi-million dollar settlements under a tower of primary and excess cyber liability policies and first-party “all risk” policies for losses incurred by a resorts and casino operator as a result of a cyberattack, including costs for forensic investigation, data recovery, property damage, and business interruption, among others. 
  • Assisted a law firm in securing coverage under its primary cyber liability policy for a ransomware attack.
  • Successfully reversed an insurance company’s denial of coverage and obtained a pre-litigation recovery under a cyber liability policy for a manufacturing company’s multi-million dollar losses from a ransomware attack.
  • Assisted a number of private companies in fraudulent funds transfer claims under fidelity crime policies for losses suffered from phishing schemes involving fraudulent wire transfer instructions.

Directors and Officers Liability

  • Represented a manufacturing company in attaining a multi-million dollar recovery in litigation against its D&O liability carrier and its insurance broker for defense costs incurred in an underlying shareholder action.
  • Assisted a pharmaceutical company in securing a recovery from its primary and excess D&O carriers for defense and indemnity losses incurred by the company and its officers in an action brought by a competitor.
  • Represented a wealth management advisory firm in an action seeking D&O coverage for costs related to a federal securities investigation.
  • Successfully procured defense costs coverage under a D&O policy for a corporate director in a criminal action.
  • Obtained D&O coverage for a retailer in connection with defense and indemnity liability in a class action lawsuit alleging violations of the TCPA.

Other Matters

  • Represented a computer technology distributions company in seeking to recover for losses sustained from a theft of computer and cybersecurity products under a fidelity crime policy.
  • Represented an electronics manufacturer in an action against several of its CGL insurers concerning long tail environmental liability claims.
  • Secured settlements for a construction general contractor under builders risk policies, contractor-controlled insurance program policies, and CGL policies.
  • Represented corporate policyholders in cases involving broker liability.
