Anderson Kill Attorneys Author Chapter on "Site Pollution Liability Insurance" in the ABA's New Book on Environmental Liability and Insurance Recovery

Anderson Kill is pleased to announce that Robert M. Horkovich, Rene F. Hertzog and Peter A. Halprin have co-authored a chapter entitled "Site Pollution Liability Insurance" in the recently published ABA book Environmental Liability and Insurance Recovery. This inaugural edition of the book was published in May 2012 by ABA Book Publishing and was sponsored by the ABA’s Tort Trial and Insurance Practice Section.

Environmental law and insurance law demand the mastery of an intricately involved set of concepts, definitions, rules, and regulations - all of which are continuously developing in response to environmental risks. Environmental Liability and Insurance Recovery addresses the legal issues at the crossroads of environmental law and insurance law. Specifically, the book addresses the diverse ways in which a party may be exposed to environmental liability and how insurance coverage may provide financial support for such liability.

The chapter authored by Anderson Kill attorneys, "Site Pollution Liability Insurance," focuses on the origins and evolution of environmental impairment liability insurance. It also includes a discussion of the primary pollution liability coverage products for site-specific environmental risks presently on the market.

About the Authors

Robert M. Horkovich has obtained over $5 billion in settlements and judgments from insurance companies for clients including the State of California, the United Nations, and several major asbestos trusts. As trial counsel for the State of California, he won a landmark jury verdict in a dispute with multiple insurance companies over coverage for cleanup of the Stringfellow Acid pits, a verdict upheld in several key particulars by the California Supreme Court. His victories include five landmark state Supreme Court Decisions, two ground breaking Court of Appeal decisions, eight jury verdicts, and eight bench trial decisions in favor of policyholders.

Rene F. Hertzog is an attorney in the Insurance Recovery Group in Anderson Kill's New York office. Ms. Hertzog's practice concentrates on insurance coverage litigation exclusively on behalf of policyholders as well as corporate and commercial litigation and environmental law matters. Ms. Hertzog is an active member in the Young Lawyers Committee at the Association of the Bar of the City of New York.

Peter A. Halprin is an attorney in Anderson Kill's New York office. Mr. Halprin's practice concentrates in commercial litigation and insurance recovery, exclusively on behalf of policyholders. His litigation practice also includes domestic and international arbitration, as well as bankruptcy, environmental law, and intellectual property matters. Mr. Halprin is actively involved in many professional associations including the ABA's Tort Trial & Insurance Practice and Dispute Resolution Sections.
