'Relation Back' Provisions in E&O and D&O Insurance Policies: Navigating a Path to Coverage

Please join Rhonda Orin and Daniel Healy for an interactive discussion of best practices to obtain insurance coverage when “relation back” provisions are implicated.  Recent trends are that many more claims fall under errors and omissions (E&O) and directors and officers (D&O) policies than in the past.  “Relation back” concepts become important whenever there are multiple claims or claimants.  The coverage implications for grouping claims as “related” or for arguing that claims do, or do not, “relate back” to other claims can have wildly divergent coverage consequences.  Understanding these common provisions can challenge even experienced insurance counsel.
