This segment will discuss the contours of disputes over building code and catastrophe coverages, including deductibles and sublimit variables, while providing an overview of common policy provisions and relevant case law. Upon completion of this session, participants will be able to:
- Advise clients on distinction between “mandatory” and “discretionary” building code upgrades pursuant to ADA and similar laws for the purpose of insurance coverage
- Advise clients on whether they can obtain coverage for repairs to undamaged portions of property
- Know how deductibles and sublimits might apply to wind and water issues and why available coverages might vary
- Prepare for policy coverage disputes that may arise over code upgrades
- Identify, avoid, or resolve disagreements over deductibles and sublimits in connection with catastrophes
