Those involved in construction should plan carefully not only how to minimize the risks of accidents but how to maximize their insurance and indemnification recoveries should an accident happen. Construction can be a dangerous activity. Despite increased attention to job safety over the last several decades, accidents on construction sites, including some catastrophic accidents, continue to occur. These accidents frequently result in bodily injuries, property damage, project delays, and resulting economic losses. Further, construction defects litigation following completion of a project is common. In most cases, prior to the commencement of the project, various risk transfer strategies are put in place. Once an accident occurs or defects litigation commences, it is time to execute on those strategies, while being mindful of common challenges and pitfalls.
This seminar will explore ways in which companies in the construction industry can maximize their insurance recoveries for contractual liability claims, including claims for contractual indemnification. We also will discuss strategies to maximize insurance recoveries as an additional insured under insurance purchased by other project participants.
