Environmental Insurance Coverage under Traditional and Specialty Policies

While Pollution Legal Liability insurance is evolving rapidly, offering coverage that is both broader in scope and tailored to specific industries, traditional lines of insurance still cover some environmental claims. For example, D&O and E&O often cover securities fraud claims originating in environmental damage, and first-party property policies generally cover environmental damage triggered by fire or storm. Coverage for government-mandated cleanup often hinges on whether settlements under NRD, RCRA or CERCLA meet the definition of an environmental claim. This session will overview the potential response of D&O, E&O, first-party property and specialty line insurance to certain environmental liabilities as well as the emerging trends in EIL and PLL underwriting.
