When business interruption claims flowed in from COVID, insurance companies responded with across the board denials regardless of jurisdiction or policy wording. Insurance industry leaders took to the airwaves to promote the notion that there was no coverage for business interruption losses caused by a virus – without disclosing that losses from SARS-C0V-1 in Asia had been covered – with the only change to policy wordings thereafter being a widespread imposition of broad virus exclusions. But the policyholders that had purchased policies without virus exclusions (about 17%, according to the NAIC) were having their claims denied. This session will provide an update on how coverage litigation over COVID business interruption claims has played out over the past two years, where things now stand, and what to expect looking ahead. The speakers on this panel have devoted their careers to resolving large-scale insurance claims and will review the legal issues that have emerged and what they mean for recovery on COVID claims.
