This program will examine recent cases addressing insurance coverage for cyber-related risks and the terms of specialty cyber insurance policies on the market. Each year, multi-national, domestic, and international companies of all sizes face increased exposure to cyber-risks due to computer hackers, data breaches, and network interruption. Those companies traditionally sought coverage under commercial general liability (“CGL”) policies or were uninsured. The marketplace for cyber is becoming increasingly sophisticated, and there are a number of products designed to cover cyber-related risks. The seminar will address the various factors and issues that courts examine in reaching their decisions about coverage under CGL and cyber insurance policies, as well as recent trends in this emerging area of law. The seminar will also discuss efforts by the insurance industry to develop new lines of cyber policies including endorsements adding limited cyber coverage to traditional coverage lines.
