This seminar will discuss a board’s authority to approve or deny requests to renovate/alter apartments and why a board should take this responsibility very seriously. This includes the fiduciary duty of each board member to look out for the interests of the co-op/condo; potential harm to building residents from a renovation; potential damage to the building; and possible lawsuits arising out of damage caused by the renovation. We will also discuss numerous examples of potentially disastrous renovation requests that we have dealt with, and how boards responded to such requests. We will also describe when a board can apply the business judgment standard of reviewing a renovation proposal and when it must use a reasonableness standard of review, and explain the differences between the two standards of review. Legal remedies available to boards where renovations have been performed without the requisite board consent will also be covered.
