This session will focus on lessons learned from recent case law addressing the meaning of key features in environmental insurance policies, including pre-existing known conditions and disclosure; claims made and reporting requirements; the reporting of claims and circumstances; the scope of covered remediation expenses; arbitration clauses and choice of law and forum clauses, together with practical advice for counsel to consider when negotiating the actual language of the environmental insurance policy for a specific transaction. In addition, the panel will provide advice on key techniques/strategies for policyholders to utilize at the time a claim is made or a pollution incident discovered to maximize the environmental insurance coverage and minimize disputes.
