Rachael Kierych is an attorney in Anderson Kill's New York office, where she concentrates her practice in corporate and commercial litigation. She has litigated a broad range of commercial disputes including breach of contract, fraud, fraudulent conveyances, fiduciary duty, and business tort matters as well as securities litigations. She is well versed in alternative dispute resolution conducting arbitrations before FINRA, the American Arbitration Association, and the International Center for Dispute Resolution. She also has mediated cases in a variety of forums including JAMS.
Ms. Kierych counsels clients including wine and spirit distributors, financial institutions, alternative investors, real estate concerns, and loan servicers. She is a member of Anderson Kill's Foreign Investment Recovery Group as well as its Regulated Products Group, recently formed to serve businesses and investors engaged in the production and sale of cannabis, alcoholic beverages and other tightly regulated legal substances.
Ms. Kierych conducts complex litigation on behalf of shareholders in public securities and closely held corporations. She prosecutes and defends employment litigation on behalf of employers and has extensive experience recovering student loan debt, including in bankruptcy proceedings.
Ms. Kierych has worked closely with David Graff, Chair of Anderson Kill's Foreign Investment Recovery Group, in a series of precedent setting actions in the Delaware Court of Chancery against several Delaware Corporations with principal operations in China that have stopped reporting financial information on U.S. public exchanges or to U.S. private investors. She has been instrumental in obtaining novel remedies, including the appointment of receivers to pursue these companies' assets, and in one case, successfully seizing assets of the company and its associates in the British Virgin Islands, Hong Kong and New York.
Prior to graduating law school in May 2012, Ms. Kierych was a legal intern in the Queens District Attorney's Office and a Judicial Extern for the Supreme Court of Ireland.
While attending Fordham Law School, Ms. Kierych was the 2011-2012 Business Editor at the Brendan Moore Trial Advocacy Center and a staff member at the Fordham Environmental Law Review. Ms. Kierych also was a recipient of the 2012 Archibald R. Murray Public Service Award.
